Hey Jak. New York is for new players, up to level 40(???), so you are fine. You may use it for podding, trading, etc. and you won't get banned. It's a simple courtessy not to stay in NY if you are a fairly old, or even a player that is playing the mod for two-three months. So, tl;dr You won't get banned.
