This is a valid point Rex and one I hope OP will eventually address by somehow making the BMGs only sellable to ships mounted with a smuggler's license in a future CF release. Hell, even I've done it before the SA declared it's non-smuggling stance on traded goods last year. This is unfortunately a very rampant problem with that license, besides as most people will argue, that's what being a smuggler is all about, "flying under the radar" and anyone can buy BMGs.
