I had the Predator test on me twice - once by Gunny and once by Kyron. Both times they were able to hit me and both times I took damage. Saying that, I am not disputing what they are saying, but in light of OPs comment about ALL custom ships being bugged in one way or another, maybe we can un ban these ships?
